A LOOK BACK AT RECENT SETTLEMENTS/VERDICTS

January 2013

Johnson City Tennessee:  $115,000.00 settlement obtained after Mediation for a gentlemen that had suffered head and shoulder injuries after being struck on a Scooter approaching a lighted intersection.

December 2012

Smyth County Virginia: Case settled prior to filing suit for $20,000.00, for a young lady that had suffered personal injury by dog bite.

Carter County Tennessee: Case settled prior to filing suit for $42,000.00, for a gentlemen that suffered personal injury to his head, neck, shoulder and back in a motor vehicle accident.

Smyth County General District Court:  Criminal case in which Client charged with 3 counts of Assault and Battery and 1 count of Damaging Property.  All Criminal charges were dismissed at trial.

 November 2012

Federal Court Greeneville Tennessee: ADR of Multiple Personal Injury Cases resulting from a 15 car chain reaction action motor vehicle crash on icy bridge outside Knoxville Tennessee results in a Confidential Recovery for the Plaintiffs.

Sullivan County Municipal Court:  Obtained Dismissal w/ Driving School for this nice lady from North  Carolina so she could avoid license suspension by the State of North Carolina.  

11/8/12: Criminal Court of Sullivan County In Blountville Tennessee: Client charged with Multiple Counts of Sexual Exploitation of a Minor for Down Loading Child Pornography. Pursuant to a Plea Bargain, Client sentenced to 2 Years @ 30% for and effective sentence of 8 Months.

October 2012

10/3/12: Sullivan County General Sessions Court in Bristol, TN: State Vs. Pateresa Hawkins; Criminal Case in which Client was charged with public intoxication and theft under $500.00. The Judge dismissed the public intoxication charge and granted the defendant Judicial Diversion for the Theft charge.

10/4/12: Washington County General District Court: Commonwealth Vs. Michele Monserrati; Client’s charge of reckless driving was amended to simple speeding and his charge of No Operator’s License was dismissed by "Complied with Law".

10/9/12: Circuit Court of Wythe County, Virginia: Commonwealth of Virginia v Chasity Hope Owens; Client had multiple drug charges ranging from Manufacture of Methamphetamine in the -Presence of a Child to Possession with Intent to Distribute.  Pursuant to a plea bargain, the charges of Possession of Precursors and Possession with intent to Distribute were dismissed.  She pled guilty to child endangerment and Conspiracy to Manufacture.  She was sentence ot only one year in the penitentiary. 

10/31/12: Criminal Court of Sullivan Count In Blountville Tennessee: State Vs. Jacob McGhee; Client was Charged with Felony Promotion of Methamphetamine/ Possession of Methamphetamine & Possession of Drug Parphernalia. Judge Beck accepted the Plea Bargain Dismissal of the Felony and Sentenced the Defendant to Probation with Drug Treatment & Supervision.

September 2012

 9/20/12:Jeffrey L. Smith v. Atlas Honda Yamaha, et al; Settlement of $8,000.00 for our client who had nothing but trouble out of the motorcycle he purchased from Atlas Honda. Yamaha tried to deny his claim stating that he had abused to motorcycle.

9/28/12: Lisa Howington Murray v. Wilderness at the Smokies, et al; Settlement of $ $20,000.00; we were retained to represent Ms. Howington Murray in her claim against Wilderness at the Smokies, et al, resulting from an incident occurring on July 3, 2010, in which Ms. Murray was a guest and had been riding its amusement rides when she was pushed up against a wall by an employee and injured.

August 2012

8/3/12: Washington County General District Court: Commonwealth of Virginia v Sudheer K. S. Kochuchirayil; Judge agreed to allow client to attend driving school to have his ticket dismissed.

July 2012

7/5/12- Russel County Virginia: $26,500.00 settlement obtained prior to filing suit for a lady that had suffered whiplash to neck and back.

7/11/12- United States District Court in Greenville, Tennessee referred two of our cases to mediation. 

7/13/12- Washington County General District Court:  Commonwealth v. James Blanton:  Obtained Dismissal  w/ Driving School so this  gentlemen from North Carolina could avoid license suspension by the State of North Carolina.  

7/19/12- Washington County J&DR:  Hall v. Donnelson:  Custody awarded to our client after trial w/ limited visitation to Mr. Hall.

7/20/12- Washington County General District:  Commonweath v. Justice:  Obtained Dismissal w/ Driving School so this nice lady from North Carolina could avoid license suspension by the State of North Carolina.  

7/24/12- Sullivan County Tennessee General Session Court:  Client charged with indecent exposure as a result of a sting operation at South Holston Dam:  Case dismissed upon completion of Judicial Diversion.

7/30/12- Smyth County Circuit Court / The Honorable Sage B. Johnson presiding:  Commonwealth v. Crawley:  Client had a long record and problem that he admitted in open court.  Client was intoxicated and lost control of his vehicle and ran into an elderly ladies home.  Client had multiple charges including DUI 2nd and Leaving the Scene.  Judge Johnson appreciated Clients admission of his problem and his efforts to correct since being charged; Therefore, Judge Johnson sentenced Client to 2 Years, but suspended all but 120 days with no probation. The effective sentence is 65 days if Client is of good behavior.

JUNE 2012

6/6/2012- Pulaski County VA:  Workers Compensation case for factory worker with neck and back pain after a lifting to a table settled for $48,000.00 prior to hearing.  

6/8/12-  Washington County, Case settled for $27,500.00 prior to filing for a gentleman who suffered personal injury to his back and neck in a motor vehicle accident.

6/13/12- Radford Va,  Medical Malpractice Case settle prior to filling for an a confidential amount. 

6/27/12- Sullivan County Tennessee / State vs. Jeffery Dick:  Charged with Driving Recklessly without a license causing of $12,0000,00 Property Damage in the resulting motor vehicle crash Granted Judicial Diversion;

MAY 2012

5/31/12-  Sullivan County Tennessee:  Case Filed for Josh Rinell Vs. John Doe and Allstate Insurance  for injuruies suffered by Josh on a Motorcycle that was crashed into by a hit and run driver.  Case settled for policy limits after filing 

5/31/12- Russel County Juvenile and Domestic Relations Court:  Grizzle v. Grizzle; At trial Custody of the parties 3 and 5 year old girls awarded our client the childrens mother b/c we proved the Defendant drank 1/2 case of beer a night and was abusive to our client.  Client also given possession of the home with a protective order in her favor.  

5/23/12- Russell County General District Court; Commonwealth v. Thomas Whited for 12 Counts of Manfacturing and Conspiracy to Manufacture Methamphetamine:  8 Counts dismissed prior to trial; 1 Count of Conspiracy dismissed after preliminary hearing;  Only 3 Counts of the original 12 certified to the Grand Jury of Russell County Virginia. 

5/23/12- Washington County General District Court:  Felony Possession of Controlled Substance schedule 1 or 2 and Possession of Drug Parphernalia Dismissed for lack of evidence at trial.

5/23/12-Washington County General District Court:  Criminal Case in which client was charged with 4 Felony Counts of forgery and obtaining money by false pretenses etc. reduced to petty larceny with payment of restitution to petty larceny, no jail time, no fines:  Defendant released on Good Behavior/ no probation.  

5 /17/12- Smyth County General District Court: Reckless by Speed reduced at trial to simple speeding with no license suspension or jail time for a North Carolina resident.  

  5/14/12- Washington County General District Court:  We obtained a $16,500.00 judgment at trial against Sonia M. Harper of Saltville Virginia for Mr. Fred C. Remines.  

5/3/12- Montgomery County Virginia:  Workers Compensation case for truck driver with neck and back pain after a motor vehicle crash settled for $48,000.00 prior to hearing.     

5/7/12- Washington County Circuit Court:  Criminal Case in which Client was charged with 72 counts of prescription fraud and conspiracy reduced to 20 counts and client sentenced to Virginia's therapeutic community for not more than 2 years 3 months.

April 2012

April 2012-Wythe County Virginia: Case settled prior to filing suit for $105,000.00 (total coverage available all sources) for a lady that had suffered aggravation of pre existing arthritis in her neck resulting from prior surgery.  

April 2012 - Smyth County Circuit Court, client charged with burglary and grand larceny, charges were reduced to simple larceny, client placed on probation with an admonition from the Court to go back to work.

4/26/2012:  In re Ethan Sheppard (6yrs old) Smyth County J&DR;  At trial, Father awarded sole custody because medical record we subpoenaed showed that Mother had overdosed on methamphetamine and was continuing to exhibit signs of addiction.  

April 2012 - Washington County General District Court at trial, driving suspended 2nd dismissed.

April 2012 - Washington County General District at trial, assault and battery charge against our client was dismissed.

April 2012 - Washington County Virginia: Workers Compensation case pending before the Commission for personal injury to Claimant’s back settled for $45,000.

April 2012 - Smyth County Virginia: Founded Complaint for physical abuse of a child that was present when a knife fight broke out in the respondent’s home dismissed after trial on appeal.

 April 2012: Reckless 98 in a 70 REDUCED to simple speeding in Washington County General District at trial.

 March 2012

March 2012 - Russell County Virginia: Workers Compensation case filed with and pending before the Commission for personal injury to Claimant’s foot settled for$14,500.00. 

March 2012- Smyth County Virginia: Workers Compensation case filed with and pending before the Commission for personal injury to Claimant’s shoulder settled for $209,000.00

March 2012 - Caroll County Virginia: Workers Compensation case filed with and pending before the Commission for personal injury to Claimant’s back occurring in Canada settled for $82,000.00. 

February 2012:

 February 2012 - Washington County Virginia: Workers Compensation case filed with and pending before the Commission for personal injury to Claimant’s back settled for $25,000.00.

 February 2012 - Washington County Circuit, Court, Case settled for $17,500.00 prior to trial for a gentleman who suffered personal injury to his back and shoulder in a motor vehicle accident.

 January 2012: 

Washington County Virginia: Workers Compensation case filed with and pending before the Commission for personal injury to Claimant’s back settled for $76,971.00
